REASONS FOR DECISION

[1] On 24 September 2002, an application was lodged by the Australian Municipal, Administrative, Clerical and Services Union, pursuant to s.23 of the Industrial Relations Act 1984, to vary the Public Vehicles Award pursuant to Principle 13 -Award Modernisation and Principle 2 - Previous State Wage Cases re Structural Efficiency and minimum rates adjustment to vary wage rates for employees other than clerical and administrative employees.

[2] A hearing was convened at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Friday 25 October 2002 at 11.30 am, and was continued on 19 December 2002, 20 February, 4 March, 26 March and 3 April 2003.

[3] This application, also gives effect to Principle 12 - Award Review Process of the Wage Fixing Principles in the manner set out in "Appendix 1" in the order.

[4] The parties presented submissions in support of the amended application.

[5] I approve the consent variations as they are consistent with the Wage Fixing Principles and the public interest requirements of the Act.

[6] The award will be varied in the manner set out in the amended draft Order and summarised in Appendix 1 attached, with the operative effect from the first full pay period to commence on or after 3 April 2003.

[7] The Order giving effect to this decision is attached.
