Award variation - wage rates - two adjustments - insert new minimum wage clause - State Wage Case July 2002 (T10230 of 2002) - consent matter - application granted - award varied - operative dates ffpp 18 December 2002 and ffpp 1 July 2003 REASONS FOR DECISION [1] On 26 November 2002 an application was lodged by the Australian Liquor, Hospitality and Miscellaneous Workers Union - Tasmanian Branch pursuant to Section 23 of the Industrial Relations Act 1984, to vary the Leather, Canvas and Sheet Plastic Fabrication Award. [2] When this matter came on for hearing on 18 December 2002, Mr P Tullgren appeared for the union. Ms J Thomas appeared for the Tasmanian Chamber of Commerce and Industry Limited (TCCI). [3] This application is a consequence of the conference process that flowed from the 11 July 2002 State wage decision.1 [4] Mr Tullgren explained that the two most recent State Wage decisions had not been applied to this Award. The application sought to remedy this position, with the first adjustment to apply from the date of decision and the second to apply from 1 July 2003. [5] The application also sought to include a Minimum Wage clause in line with the Full bench decision. [2] Ms Thomas advised that the TCCI consented to the application. [6] I am satisfied that the application is consistent with the requirements of both the Wage Fixing Principles and the public interest requirements of the Act. [7] The award will be varied effective from the beginning of the first full pay period to commence on or after 18 December 2002 with the second wage adjustment to apply from the beginning of the first full pay period to commence on or after 1 July 2003. [8] The Order [Correction Order]reflecting these variations is attached.
