Award variation - wage rates - minimum wage - insert new minimum wage clause - State Wage Case July 2002 (T10230 of 2002) - consent matter - application granted - award varied - operative date ffpp 18 December 2002 REASONS FOR DECISION [1] On 13 December 2002 an application was lodged by the Health Services Union of Australia, Tasmania No 1 Branch, pursuant to Section 23 of the Industrial Relations Act 1984, to vary the Hospitals Award. [2] When this matter came on for hearing on 18 December 2002, Mr T Kleyn appeared for the union. Mr M Watson appeared for the Tasmanian Chamber of Commerce and Industry Limited (TCCI). [3] This application is a consequence of the conference process that flowed from the 11 July 2002 State Wage decision.1 [4] Mr Kleyn explained that the following variations were sought:
[5] Mr Watson advised that the TCCI consented to the application. [6] I am satisfied that the application is consistent with the Wage Fixing Principles and the public interest requirements of the Act. [7] The application is granted and the award will be varied effective from the beginning of the first full pay period to commence on or after 18 December 2002. [8] The Order reflecting this decision is attached.
