BARGAINING AGREEMENT

REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Tasmanian Country Club Casino Propriety Limited (ACN 009 516 819) (the employer), the Australian Liquor, Hospitality and Miscellaneous Workers Union - Tasmanian Branch (the ALHMWU), the Construction, Forestry, Mining and Energy Union, Tasmanian Branch (the CFMEU) and the Communications, Electrical, Electronic, Energy, Information, Postal, Plumbing and Allied Services Union of Australia (CEEEIPPASU), was for the purpose of filing an industrial agreement with the Commission.

[2] The agreement, to be known as the Country Club Casino (Maintenance) Enterprise Bargaining Agreement 2001, is to be operative from the first full pay period to commence on or after 1 May 2001 and is to remain in force until 30 April 2004.

[3] Essentially, this agreement reflects provisions of the previous agreement, namely the "Country Club Casino Maintenance Department Enterprise Bargaining Agreement 1997", except for the following:

  • Increase the wage rates as set out below:

2.5% for the first pay period after 1 July 2001;
2.5% for the first pay period after 1 July 2002; and
2.5% for the first pay period after 1 July 2003.

  • Clause 2.1 - Job Security for permanent employees; and
  • Clause 3.7 - Income Protection Insurance for all employees employed as at 1 August 1995.

[4] Ms C Furness for the employer; Mr B White for the CFMEU, and Mr K Harkins for the CEEEIPPASU and the ALHMWU, presented submissions in support of their consent application.

[5] Having considered the submission of the parties, I am satisfied the agreement should be approved as it is consistent with the public interest requirements of the Act, and I decide accordingly.

[6] The file will now be referred to the Acting Registrar in accordance with the requirements of s.56(1) of the Act
