WORK & TRAINING-ASU-ISCU TRAINEE AGREEMENT 2003

REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Australian Municipal, Administrative, Clerical and Services Union (the AMACSU) and Work and Training Limited (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] The matter was listed for hearing at 2.30 pm on Wednesday, 15 January 2003 at the Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania.

[3] The agreement, to be known as the Work & Training-ASU-ISCU Trainee Agreement 2003, is to be operative from the first full pay period to commence on or after 1 January 2003 and is to remain in force for a period of three years.

[4] The purpose of the agreement is to provide wage rates and conditions of employment for all trainees employed by the employer and hosted out to Island State Credit Union Limited.

[5] Shortly stated, the agreement is divided into eight parts under the following headings:

    Part I - Application and Operation of the Agreement
    Part II - Employment Relationships and Associated Matters
    Part III - Wages and Related Matters
    Part IV - Allowances
    Part V - Hours of Work and Overtime
    Part IV - Leave and Holidays with Pay
    Part VII - Consultation and Dispute Resolution Change and Redundancy
    Part III - Award Compliance and Union related Matters

[6] In addition the agreement is to be interpreted wholly in conjunction with the Public Accountants Award and the National Training Wage Tasmanian (Private Sector) Award (being awards of the Tasmanian Industrial Commission), and where there is any inconsistency between the agreement and the award the agreement shall prevail to the extent of the inconsistency.

[7] Mr CJ Dodds for AMACSU and Mr B Lipscombe for the employer, presented submissions in support of their consent application.

[8] Having considered the submission of the parties, I am satisfied the agreement should be approved as it is consistent with the public interest requirements of the Act, and I decide accordingly.

[9] The file will now be referred to the Acting Registrar in accordance with the requirements of s.56(1) of the Act.
