Industrial Agreement - agreement approved - operative 1 August 2002 - to remain in force for a period of 3 years - forwarded to the Acting Registrar for registration REASONS FOR DECISION [1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 (the Act) by the Shop Distributive and Allied Employees Association, Tasmanian Branch (the union) and Launtoy Pty Limited (the employer), was for the purpose of filing an industrial agreement with the Commission. [2] On 7 January 2003, the Commission convened a hearing at the Supreme Court, Cameron Street, Launceston, Tasmania, before myself, to commence at 9.15 am on Friday, 31 January 2003. [3] The agreement, to be known as the Launceston Toyworld Industrial Agreement 2002, will apply to all employees of the employer at shops 11-12 and 94 York Street, Launceston in Tasmania and will be operative from the 1 August 2002 and remain in force for a period of three years. [4] The purpose of the agreement is to assist the employer to maximise productivity and flexibility, and security of employment for employees. [5] Mr J Russell for the union and Mr A Cameron, from the Tasmanian Chamber of Commerce and Industry Limited, for the employer presented submissions in support of their consent application. [6] Having considered the submission of the parties, I am satisfied the agreement should be approved as it is consistent with the public interest requirements of the Act, and I decide accordingly. [7] The file will now be referred to the Acting Registrar in accordance with the requirements of s.56(1) of the Act.
