REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Health Services Union of Australia, Tasmania No. 1 Branch (the HSUA) and Glenview Home Inc. (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] The matter was listed for hearing on 7 February 2003 at the Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania.

[3] The agreement, to be known as The Glenview Banksia Staff Salary Packaging Agreement 2003, is to be operative from 1 February 2003 and is to remain in force until 1 March 2005.

[4] The purpose of the agreement is to permit all employees covered by the agreement, who elect in writing to do so, to convert part of their salary, excluding overtime and allowances, to packaged benefits allowed under relevant legislation. The salary packaging arrangement enables employees to receive a fringe benefit payment each fortnight, which is offset by a reduction in their gross salary entitlement to the same value as the fringe benefit payment.

[5] Mr C Stringer for the HSUA and Mr J O"Neill, from the Tasmanian Chamber of Commerce and Industry Limited, for the employer, presented submissions in support of their consent application.

[6] Having considered the submission of the parties, I am satisfied the agreement should be approved as it is consistent with the public interest requirements of the Act, and I decide accordingly.

[7] The file will now be referred to the Acting Registrar in accordance with the requirements of s.56(1) of the Act.
