Industrial Agreement - agreement approved - operative 1 November 2002 - for a period of 2 years - forwarded to the Acting Registrar for registration

 REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the National Union of Workers, Tasmanian Branch and Woolworths Limited, was for the purpose of filing an industrial agreement with the Commission.

[2] On 14 February 2003, the Commission convened a hearing at the Supreme Court, Cameron Street, Launceston, Tasmania, before myself, to commence on 28 March 2003 at 11.15 am.

[3] The agreement, to be known as the Woolworths Limited Hobart Distribution Centre - National Union of Workers Enterprise Agreement 2002-2004, is to be operative from the first full pay period to commence on or after 1 November 2002 and it is to remain in force for a period of two years.

[4] The agreement applies to all distribution centre employees (for whom classifications appear in the agreement) employed by Woolworths Limited at the drygoods distribution warehouse at 20 Lampton Avenue, Derwent Park, Tasmania.

[5] Mr D Strickland with Ms K Wood for the National Union of Workers, Tasmanian Branch, and Mr S Slipais, with Mr C Claridge and Mr M Stenson for Woolworths Limited, presented submissions in support of their consent application.

[6] Having considered the submission of the parties, I am satisfied the agreement should be approved as it is consistent with the public interest requirements of the Act, and I decide accordingly.

[7] The file will now be referred to the Acting Registrar in accordance with the requirements of s.56(1) of the Act.
