REASONS FOR DECISION

(1) On 14 February 2003 The Australasian Meat Industry Employees Union, Tasmanian Branch and Tasman Group Services trading as Longford Meat Company lodged with the Acting Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Tasman Group Services - Longford Meat Company Industrial Agreement 2002.

(2) When this matter came on for hearing on 5 March 2003, Mr G Courtney with Mr P Smith appeard for the Union. Mr A Cameron, of the Tasmanian Chamber of Commerce and Industry Limited, with Mr B Castricum, appeared for the employer.

(3) Mr Courtney explained that this Agreement was all embracing in that it replaced all other Awards, Agreements and over Award arrangements. Previously the Longford Meat Company site had been regulated by the SBA Foods Pty Ltd (Longford Plant) Certified Agreement 2000, which was registered under the Commonwealth Act.

(4) The Agreement provides for a 3% increase in the base rate for non-tally workers and a 2.5% increase in the rate per unit for tally workers.

(5) The Agreement contains a No Extra Claims clause to apply for the duration of the Agreement except when consistent with the Agreement.

(6) Mr Cameron supported the submissions of Mr Courtney.

(7) I am satisfied that the Agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

(8) Pursuant to Section 55[4] of the Act, the Agreement is approved effective from the beginning of the first full pay period to commence on or after 5 August 2002 and shall remain in force for a period of one year.

(9) The file will now be referred to the Acting Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
