Industrial Agreement - agreement approved - operative 1 January 2003 for a period of two years - forwarded to the Acting Registrar for registration

REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Australian Municipal, Administrative, Clerical and Services Union (the union) and the Australian Labor Party Tasmanian Branch (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] On 27 February 2003, the Commission convened a hearing at the Commonwealth Law Courts, 39-41 Davey Street, Hobart, before myself, to commence on Friday 14 March 2003 at 9.30 am.

[3] The agreement, to be known as the ASU - Australian Labor Party - Tasmanian Branch Agreement 2003, is to be operative on and from 1 January 2003 and it is to remain in force for a period of two years.

[4] The agreement applies to the Australian Labor Party Tasmanian Branch and the Australian Municipal, Administrative, Clerical and Services Union. It shall be read and interpreted wholly in conjunction with the Clerical and Administrative Employees (Private Sector) Award.

[5] Oral submissions were presented by Mr I Paterson for the union and Mr D Price on behalf of the employer.

[6] Having considered those submissions, I am satisfied the agreement should be approved as it satisfies s.36 of the Act.

[7] The file will now be referred to the Acting Registrar in accordance with the requirements of s.56(1) of the Act.
