Industrial agreement - application approved - operative date 1/2/03 to 31/5/05 - forwarded to A/Registrar for registration REASONS FOR DECISION (1) On 5 March 2003 The Australian Workers' Union, Tasmania Branch and Woodstock Forest Service lodged with the Acting Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Woodstock Forest Service Silviculture and Afforestation Industrial Agreement 2003. (2) When this matter came on for hearing on 11 March 2003, Mr R Flanagan appeared for the union. Mr R Grimes appeared for the employer. (3) Mr Flanagan explained that this Agreement replaced the Woodstock Forest Service Enterprise Agreement 2000 registered under Part IVA of the Act. (4) The Agreement is to cover a workforce that fluctuates between 30 and 70, depending on seasonal considerations. As is the norm in the industry, employees are primarily engaged on a piecework basis. (5) The Agreement provides that wage rates shall be adjusted in line with State Wage Case Decisions. The Agreement also contains a "No Further Claims" clause. (6) Mr Grimes supported the submissions of Mr Flanagan. (7) I am satisfied that the Agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act. (8) Pursuant to Section 55[4] of the Act, the Agreement is approved operative from 1 February 2003 and shall remain in force until 31 May 2005. (9) The file will now be referred to the Acting Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
