Award variation - application amended - wage rates - 4th Minimum Rate Adjustment - application granted - award varied - operative date ffpp 1 April 2003

REASONS FOR DECISIONS

[1] This amended application, pursuant to s.23 of the Industrial Relations Act 1984, was made by the Shop, Distributive and Allied Employees Association, Tasmanian Branch (the union) and lodged on 19 March 2003.

[2] The application sought to vary the Hairdressing, Health And Beauty Industry Award; and, in particular, to include the fourth and final Minimum Rate Adjustment in the following manner:

  • In Part I - Application and Operation of the Award, Clause 2 - Index, Clause 4 - Date of Operation and Clause 6 - Supersession and Savings are varied;

  • The title "Part III - Wages And Allowances And Related Matters" is changed to "Part III - Wages, Allowances And Related Matters";

  • In Part III - Wages, Allowances And Related Matters, Division A, Clause 1 - Classification Descriptors and Division B, Clause 1 - Classification Descriptors amalgamated; Division A, Clause 2 - Wage Rates and Division B, Clause 2 - Wage Rates amalgamated; divisions removed; subsequent clauses from Division C renumbered; and

  • In Part III - Wages, Allowances And Related Matters, Clause 2 - Wage Rates is varied to include the 4th and final Minimum Rate Adjustment.

[3] Mr P Griffin for the Union, Mr A Steven for The Hairdressing Federation of Tasmania and Ms J Thomas for the Tasmanian Chamber of Commerce and Industry Limited, presented submissions in support of the consent application.

[4] Given the submissions of the parties and the degree of consent, I approve the variation to the award in the manner sought by Mr Griffin.

[5] The Order [Correction Order] giving effect to this decision is attached.
