REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Australian Education Union, Tasmanian Branch (the employer) and the Tasmanian Union of Professional and Clerical Officers in Education (the union), was for the purpose of filing an industrial agreement with the Commission.

[2] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart, on Thursday 10 April 2003 at 9.30 am.

[3] The agreement, to be known as the AEU Tasmanian Branch Employees' Agreement 2002, is to be operative on and from 10 April 2003 and it is to remain in force for a period not exceeding three years.

[4] The agreement applies to all employees of the Australian Education Union, Tasmanian Branch unless otherwise agreed by the employer and the union.

[5] Oral submissions were presented by Mr C Lane for the Australian Education Union, Tasmanian Branch and by Mr D Elliott for the Tasmanian Union of Professional and Clerical Officers in Education.

[6] At the hearing Mr Elliott handed up an amended agreement. Mr Lane handed up an Addendum outlining actual salary levels as at 28 March 2003. The Arrangement was also amended.

[7] Having considered the submissions, I am satisfied the agreement should be approved as it satisfies s.36 of the Act.

[8] The file will now be referred to the Acting Registrar in accordance with the requirements of s.56(1) of the Act.
