REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Australian Municipal, Administrative, Clerical and Services Union (AMACSU) and Northern Group Training Ltd (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] A hearing was convened at Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania, before myself, on Tuesday, 15 April 2003 at 10.30 am.

[3] The agreement, to be known as the NGT - ASU School Based Traineeship Agreement 2003, is to be operative on and from 15 April 2003 and will remain in force for a period of one year. This agreement supersedes T10086 of 2002.

[4] At the hearing, and with the consent of the parties', I amended Clause 5 - Term of Operation and Clause 7 - Definitions - Trainee - subclause (b).

[5] The purpose of the agreement is:

"(a) the development of appropriate employment conditions for School Based Trainees, which are no less than the entitlements of a non-school based trainee undertaking a similar traineeship;

(b) provision of an opportunity for secondary school students to undertake paid on the job training in order to achieve the specified qualification;

(c) improvement in the prospects of ongoing employment for the trainee."

[6] Mr I Paterson for AMACSU and Mr J Glisson for the employer, presented submissions in support of the consent application.

[7] Having considered the submission of the parties, I am satisfied the agreement should be approved as it is consistent with the public interest requirements of the Act, and I decide accordingly.

[8] The file will now be referred to the Acting Registrar in accordance with the requirements of s.56(1) of the Act.
