(T10806 of 2003)

TASSAL LIMITED (RECEIVERS AND MANAGERS APPOINTED) AND
THE AUSTRALIAN WORKERS UNION (OPERATIONAL ADJUSTMENTS)
INDUSTRIAL AGREEMENT 2003

COMMISSIONER T J ABEY

HOBART, 14 April 2003

Industrial agreement - application approved - operative date ffpp 17 March 2003 - forwarded to A/Registrar for registration

REASONS FOR DECISION

(1) On 14 April 2003 The Australian Workers' Union, Tasmania Branch and Tassal Limited (Receivers and Managers Appointed) lodged with the Acting Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Tassal Limited (Receivers and Managers Appointed) and The Australian Workers Union (Operational Adjustments) Industrial Agreement 2003.

(2) When this matter came on for hearing on 14 April 2003, Mr I Wakefield appeared for the union. Mr J Bronstein, a solicitor, sought and was granted leave to appear, together with Ms S Gibson and Mr M Green, for Tassal Limited (Receivers and Managers Appointed).

(3) The parties explained that the purpose of this Agreement was to give legal effect to a settlement reached in a recent dispute.1 This settlement culminated in a recommendation issued by the Commission which was subsequently endorsed by the workforce.

(4) Having heard the parties I am satisfied that the Agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

(5) Pursuant to Section 55[4] the Agreement is approved. The Agreement shall operate from the beginning of the first pay period to commence on or after 17 March 2003 and shall operate until the Parent Agreement is re-negotiated or 17 September 2003, whichever occurs first.

(6) The file will now be referred to the Acting Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
