ASSOCIATION FOR CHRISTIAN HOMES FOR THE AGED (PERSONAL CARE ASSISTANTS) INDUSTRIAL AGREEMENT 2002

REASONS FOR DECISION

(1) On 23 April 2003 the Health Services Union of Australia, Tasmania No. 1 Branch and the Association for Christian Homes for the Aged Inc. lodged with the Acting Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Association for Christian Homes for the Aged (Personal Care Assistants) Industrial Agreement 2002.

(2) When this matter came on for hearing on 15 May 2003, Mr V Lefleur appeared for the HSUA. Mr M Watson, of the Tasmanian Chamber of Commerce and Industry Limited, appeared for the Association for Christian Homes for the Aged Inc.

(3) Mr Watson explained that the purpose of the Agreement was to facilitate multiskilling across the functional areas of extended care, food services and housekeeping. Employees appointed to such a position are to be paid at the rate applicable to an Extended Care Assistant Level 4.

(4) The Agreement also provides for split shifts and comprehensive redundancy clause.

(5) I am satisfied that the Agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

(6) Pursuant to s.55[4], the Agreement is approved operative from 26 August 2002 and shall operate for a period of 12 months.

(7) The file will now be referred to the Acting Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
