REASONS FOR DECISION

[1] This is an application by the Australian Liquor, Hospitality and Miscellaneous Workers Union - Tasmanian Branch (ALHMWU), lodged pursuant to s.65A of the Industrial Relations Act 1984, seeking a determination of interest in the above award.

[2] The President has referred the application, pursuant to Section 65A[2], to myself for hearing and determination and, if necessary, subsequent award variation.

[3] The application was set down for hearing in the Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania on Tuesday, 13 May 2003 at 10.30 am.

[4] Mr P Tullgren, appearing for the ALHMWU, presented submissions in support of the application which satisfied the requirements of s.63[10][c][i] and [ii] in that:

    (a) the membership of the organisation consists of or includes members who are employees in the industry or occupation to which the award relates; and

    (b) that membership is consistent with the organisation's rules lodged with the registrar.

[5] I am also satisfied that the granting of the application would not prejudice the orderly conduct of industrial relations in Tasmania thus meeting the requirements of s.63(10)(c)(iii).

[6] Given the above, the application is granted and will be operative from 13 May 2003 and, pursuant to s.63(12A), the National Training Wage (Tasmanian Private Sector) Award will be varied to reflect this decision.

[7] A copy of this determination will be forwarded to the Acting Registrar in accordance with s.63[12] of the Act.
