Industrial dispute - alleged breach of award - directions DIRECTIONS (1) On 29 April 2003, the Construction, Forestry, Mining and Energy Union, Tasmanian Branch (the applicant) applied to the President, pursuant to Section 29(1) of the Industrial Relations Act 1984, for a hearing before a Commissioner in respect of an industrial dispute with HBMI Pty Ltd arising out of an alleged breach of award with respect to Stuart Classener. (2) This matter was listed for a conciliation conference on 29 May 2003 at the Commonwealth Law Courts, 39-41 Davey Street, Hobart. Mr W White appeared for the union. Mr P Mazengarb, of the Tasmanian Chamber of Commerce and Industry Limited, appeared with Ms J Cooke, Mr M Pilcher and Mr K Dillon, for the employer. (3) Pursuant to s.21[n] of the Act I issue the following directions: 1. The CFMEU is to provide the employer with full particulars of the claim not later than 5.00pm on Friday 20 June 2003. 2. The employer is to respond to the CFMEU not later than 5.00pm on Wednesday 2 July 2003 indicating matters which are agreed and matters which are contested. 3. The parties are to exchange the names of any witnesses to be called not later than 5.00pm on Friday 4 July 2003. The application is listed for hearing at 9.30am on Tuesday 8 July 2003 and 9.30am Wednesday 9 July 2003 (notice attached).
