(T10891 of 2003)

THE ROOFING CENTRE INDUSTRIAL AGREEMENT

DEPUTY PRESIDENT R J WATLING

HOBART, 17 June 2003

Industrial Agreement - agreement approved - operative 1 June 2003 - for a period of 36 months - forwarded to the Acting Registrar for registration

REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by The Australian Workers' Union, Tasmania Branch (the union) and The Roofing Centre Tasmania Pty Ltd (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] The agreement, to be known as The Roofing Centre Industrial Agreement, is to be operative from 1 June 2003 and is to remain in force for a period of 36 months.

[3] This agreement is similar to a previous agreement registered with the Commission T 8633 of 1999. However, it differs to the extent that the scope has been expanded and is intended to cover all employees at the Devonport, Hobart and Launceston operations.

[4] The agreement contains weekly wage rates and numerous conditions of employment. During the life of the agreement the weekly wage rates, applying immediately prior to the commencement date of this agreement, will be increased on 1 June 2003, 1 February 2004 and 1 February 2005.

[5] At Part VIII - Occupational Health & Safety, Tools and Amenities provision has been made for specified items of safety clothing.

[6] Mr R Flanagan for the union and the employer presented submissions in support of the application.

[7] Having considered the submissions of the parties in this matter, I am satisfied the agreement should be approved as it is consistent with the public interest requirements of the Act, and I decide accordingly.

[8] The file will now be referred to the Acting Registrar in accordance with the requirements of s.56(1) of the Act.
