REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union (the union) and Montague Cold Storage [Tasmania] Pty Ltd (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] A hearing commenced at the Magistrates Court, 19 King Edward Street, Ulverstone, Tasmania on Tuesday 15 July 2003 at 9.30 am.

[3] The agreement, to be known as the Montague Cold Storage [Tasmania] Pty Ltd Devonport Agreement 2003, is to be operative on and from 10 January 2003 and it is to remain in force for a period of two years.

[4] The agreement applies to all of the employers employees who are employed at the employer's establishment at Montague Devonport and employed in classifications of occupations covered by the agreement in Clause 7 and/or are eligible for membership of the union, whether members of the union or not.

[5] Oral submissions were presented by Ms A Urquhart of the Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union . Mr S Howard of Montague Cold Storage [Tas] Pty Ltd sent a facsimile authorising Ms Urquhart to appear on the employer's behalf.

[6] Having considered those submissions, I am satisfied the agreement should be approved as it satisfies s.36 of the Act.

[7] The file will now be referred to the Acting Registrar in accordance with the requirements of s.56(1) of the Act.
