Award variation - Clause 1(d) of Part III- consent matter - application granted - award varied - operative date ffpp 31 July 2003 REASONS FOR DECISION [1] On 24 June 2003, an application was lodged by the Transport Workers' Union of Australia (Victorian/Tasmanian Branch), pursuant to s.23 of the Industrial Relations Act 1984, to vary the Dairy Processing Award. [2] The application was of a minor technical nature to reflect the current Federal Award that applies in the Milk Industry. [3] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Thursday 31 July 2003 at 10.30 am. [4] At the hearing Mr M Cook appeared on behalf of the Transport Workers' Union of Australia (Victorian/Tasmanian Branch). [5] Mr Cook presented a submission in support of the amended application. [6] I approve the consent variation as it is of a purely technical nature and is consistent with the public interest requirements of the Act. [7] The award will be varied in the manner set out in the amended draft Order and with the operative effect from the first full pay period to commence on or after 31 July 2003. [8] The Order giving effect to this decision is attached.
