REASONS FOR DECISION

[1] On 26 June 2003, an application was lodged by the Transport Workers' Union of Australia (Victorian/Tasmanian Branch), pursuant to s.23 of the Industrial Relations Act 1984, to vary the Carriers Award.

[2] The application sought to vary the award Clauses 29 - Mealtimes and 43 - Travelling Allowance, both regarded as expense-related allowances.

[3] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Wednesday 30 July 2003 at 10.30 am.

[4] At the hearing Mr M Cook and Mr I Hall appeared for the Transport Workers' Union of Australia (Victorian/Tasmanian Branch) while Mr A Cameron appeared for the Tasmanian Chamber of Commerce and Industry Limited.

[5] The parties presented submissions in support of the amended application.

[6] I now confirm my decision, given on the day of the hearing, that the award should be varied in the manner sought, with an operative date of the first full pay period on or after 1 August 2003.

[7] The Order giving effect to this decision and to the decision of the Full Bench of 10 July 2003, T10886 etc, is attached.
