REASONS FOR DECISION

(1) On 21 July 2003 the Australian Municipal, Administrative, Clerical and Services Union and the Australian Nursing Federation (Tasmanian Branch) lodged with the Acting Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the ANF Administrative Staff Agreement 2003.

(2) When this matter came on for hearing on 24 July 2003, Mr I Paterson appeared for the Australian Municipal, Administrative, Clerical and Services Union, and Ms N Ellis appeared for the Australian Nursing Federation (Tasmanian Branch).

[3] Mr Paterson explained that this Agreement was to formalise and ensure the enforceability of wage rates and conditions of employment for all non-elected administrative staff employed by the ANF [Tasmanian Branch].

[4] Mr Paterson noted in particular that this included the application of the State Services Wage Agreement as varied from time to time.

[5] The Agreement embraced the full range of conditions of employment including a comprehensive Grievance Procedure.

[6] Ms Ellis endorsed the submissions of Mr Paterson and indicated that the ANF was anxious to ensure that administrative employees were covered by an enforceable, registered agreement.

[7] I am satisfied that the Agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[8] Pursuant to s. 55[4] of the Act, the Agreement is approved operative from the beginning of the first pay period to commence on or after 24 July 2003 and shall remain in force for a period of three years.

(9) The file will now be referred to the Acting Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
