REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the National Union of Workers (Central Branch) (the Union) and Statewide Independent Wholesalers Limited (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] On 22 July 2003, the Commission convened a hearing at the Supreme Court, Cameron Street, Launceston, Tasmania, before myself, to commence on Friday, 8 August 2003 at 9.30 am. This was subsequently changed to Thursday, 7 August 2003 at 11.00 am.

[3] The agreement, to be known as the Statewide Independent Wholesalers Grocery Distribution Centre - National Union of Workers Enterprise Agreement 2002/2004, is to be operative from 1 November 2002 and it is to remain in force until 1 November 2004.

[4] The agreement applies to all employees for whom classifications appear in the agreement of Statewide Independent Wholesalers Limited at its Grocery Distribution Centre located at 5 Trotters Lane, Prospect.

[5] Ms K Wood for the Union; and Mr A Cameron, from the Tasmanian Chamber of Commerce and Industry Limited, with Ms J Squires for Statewide Independent Wholesalers Limited, presented submissions in support of the consent application.

[6] Having considered the submission of the parties, I am satisfied the agreement should be approved as it is consistent with the public interest requirements of the Act, and I decide accordingly.

[7] The file will now be referred to the Acting Registrar in accordance with the requirements of s.56(1) of the Act.
