REASONS FOR DECISION

[1] This is an application by The Association of Independent Schools of Tasmania Incorporated (AISTI), lodged pursuant to s.65A of the Industrial Relations Act 1984, seeking a determination of interest in the above awards.

[2] The President has referred the application, pursuant to Section 65A[2], to myself for hearing and determination and, if necessary, subsequent award variation.

[3] The application was set down for hearing in the Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania on Wednesday, 30 July 2003 at 2.15 pm.

[4] Mr M Shorter, appearing for the AISTI, presented submissions in support of the application which satisfied the requirements of s.63[10][c][i] and [ii] in that:

    (a) the membership of the organisation consists of or includes members who are employees in the industry or occupation to which the award relates; and

    (b) that membership is consistent with the organisation's rules lodged with the registrar.

[5] Mr R Mecklenburgh for The Tasmanian Independent Schools Teachers Association did not oppose the application.

[6] I am also satisfied that the granting of the application would not prejudice the orderly conduct of industrial relations in Tasmania thus meeting the requirements of s.63(10)(c)(iii).

[7] Given the above, the application is granted and will be operative from 30 July 2003 and, pursuant to s.63(12A), the Child Care And Childrens Services Award, Independent Schools (Non Teaching Staff) Award, Independent Schools (Teachers) Tasmania Award will be varied to reflect this decision.

[8] A copy of this determination will be forwarded to the Acting Registrar in accordance with s.63[12] of the Act.
