REASONS FOR DECISION

[1] On 6 August 2003, the Health Services Union of Australia Tasmania No 1 Branch and the Queen Victoria Home Inc lodged with the Acting Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984 (the Act), the Queen Victoria Home Inc (Trainee Enrolled Nurse) Industrial Agreement 2003.

[2] When this matter came on for hearing on 22 August 2003, Mr T Kleyn appeared for the Health Services Union of Australia Tasmania No 1 Branch, and Ms J Thomas, Tasmanian Chamber of Commerce and Industry Limited, appeared for the Queen Victoria Home Inc.

[3] Mr Kleyn explained that the purpose of this Agreement was to establish arrangements whereby employees named in the Agreement, can, with the support of the employer, undertake the Certificate IV in Health (Nursing). In particular the Agreement facilitates off-the-job training.

[4] Ms Thomas supported the submissions of Mr Kleyn.

[5] I am satisfied the Agreement is consistent with both the Wage Fixing principles and the public interest requirements of the Act.

[6] Pursuant to s55(4) of the Act, the Agreement is approved operative from the beginning of the first pay period to commence on or after 1 August 2003 and shall remain in force for a period of two years.

[7] The file will now be referred to the Acting Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
