REASONS FOR DECISION

[1] On 13 August 2003, an application was lodged by the Association of Professional Engineers, Scientists and Managers, Australia, pursuant to s.23 of the Industrial Relations Act 1984, to vary the Professional Engineers and Scientists (Private Industry) Award.

[2] The applicant sought to insert a new Clause 3 - Requirement to Work Reasonable Overtime in Part V - Hours of Work and Overtime to comply with the Tasmanian Industrial Commission Full Bench decision of 10 July 2003, T10886 of 2003.

[3] A hearing commenced on Thursday 18 September 2003 at 10.00 am. At the hearing, Mr D Pyrke appeared for the Association of Professional Engineers, Scientists and Managers, Australia while Mr J O'Neill appeared on behalf of the Tasmanian Chamber of Commerce and Industry Limited.

[4] The parties presented submissions in support of the amended application.

[5] I approve the consent variations as they are consistent with the Wage Fixing Principles and the public interest requirements of the Act.

[6] The Order giving effect to this Decision is attached.
