REASONS FOR DECISIONS

[1] This amended application, pursuant to s.23 of the Industrial Relations Act 1984, was made by the Shop, Distributive and Allied Employees Association, Tasmanian Branch (the union) and lodged on 19 August 2003.

[2] The application sought to vary the Hairdressing, Health And Beauty Industry Award to: include the increase in wage rates and allowances arising out of State Wage Case July 20031;increase the meal allowance to $12.30; increase the Supported Wage to $60 per week; and include a provision in respect to Reasonable Hours of work.

[3] Mr P Griffin for the Union, Mr A Steven for The Hairdressing Federation of Tasmania and Ms J Thomas for the Tasmanian Chamber of Commerce and Industry Limited, presented submissions in support of the consent application which they agreed should be operative from the first full pay period to commence on or after 1 October 2003.

[4] The parties present at the hearing also foreshadowed their intention to review the wage relativities for the classifications of Salon Co-0rdinator and Salon Assistant contained in Part III - Wages, Allowances and Related Matters - Clause 2(a), and the classifications of Beauty Consultant Level 1 and Salon Co-0rdinator contained in Part III - Wages, Allowances and Related Matters - Clause 2(b) of the award. This, they submitted, would be undertaken during their discussions surrounding the introduction of the Minimum Wage to this award and would result in an application being lodged with the Commission prior 31 December 2003.

[5] The parties also agreed that, in future, any increases arising out of the State Wage Case should be reflected in this award from the operative date specified in that decision.

[6] Given the submissions of the parties and the degree of consent, I approve the variation to the award in the manner sought by the parties.

[7] The Order giving effect to this decision is attached.
