Industrial Agreement - agreement approved - operative 12 September 2003 for a period of three years - forwarded to the Acting Registrar for registration REASONS FOR DECISION [1] This application, lodged on 27 August 2003 pursuant to s.55 of the Industrial Relations Act 1984 by the Health Services Union of Australia, Tasmania No. 1 Branch (the union) and Plane Tree Studio Inc. (the employer), was for the purpose of filing an industrial agreement with the Commission. [2] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Friday 12 September 2003 at 9.30 am. [3] The agreement, to be known as the Plane Tree Studio Inc.(Employment Conditions) Industrial Agreement 2003, is to be operative on and from 12 September 2003 and it is to remain in force for a period of three years. [4] The agreement applies to all employees who are in receipt of a Disability Support Pension (whether members of a registered organisation or not) who are employed by the employer. [5] At the hearing Mr T Kleyn appeared on behalf of the union with Ms A Grima and Mr P Lunn appeared on behalf of Plane Tree Studio Inc. [6] Oral submissions were presented by Mr Lunn for the employer and by Mr Kleyn for the union. [7] Having considered those submissions, I am satisfied the agreement should be approved as it satisfies s.36 of the Act. [8] The file will now be referred to the Acting Registrar in accordance with the requirements of s.56(1) of the Act.
