Industrial Agreement - agreement approved - operative 1 August 2003 until 1 July 2006 - forwarded to the Acting Registrar for registration REASONS FOR DECISION [1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Health Services Union of Australia, Tasmania No. 1 Branch (the union) and Glenview Home Inc. (the employer), was for the purpose of filing an industrial agreement with the Commission. [2] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Friday 16 September 2003 at 11.30 am. [3] At the hearing Ms D Carnes appeared for the Health Services Union of Australia, Tasmania No. 1 Branch with Mr T Kleyn. Ms J Thomas of the Tasmanian Chamber of Commerce and Industry Limited appeared on behalf of Glenview Home Inc. with Ms C Calver. [4] The agreement, to be known as the Glenview Outreach Department Agreement 2003, is to be operative on and from 1 August 2003 and it is to remain in force until 1 July 2006. [5] The agreement applies to employees employed by Glenview Home Inc. in its community-based Outreach Department. [6] Oral submissions were presented by Ms Carnes on behalf of the union and by Ms Thomas on behalf of the employer. [7] Having considered those submissions, I am satisfied the agreement should be approved as it satisfies s.36 of the Act. [8] The file will now be referred to the Acting Registrar in accordance with the requirements of s.56(1) of the Act.
