TASMANIAN INDUSTRIAL COMMISSION

Industrial Relations Act 1984
s.23 application for an award or variation of an award

Australian Municipal, Administrative, Clerical & Services Union
(T11064 of 2003)

ENTERTAINMENT AWARD

PRESIDENT P L LEARY

HOBART, 25 November 2003

Award variation - 38 hour week adjustment - application approved - operative date ffpp 1 December 2003

REASONS FOR DECISION

[1] This is an application by the Australian Municipal, Administrative, Clerical & Services Union to vary, by consent, the Entertainment Award.

[2] Mr I Paterson appeared for the Australian Municipal, Administrative, Clerical & Services Union (AMACSU) and Ms J Thomas appeared for the Tasmanian Chamber of Commerce and Industry Limited (TCCI).

[3] The application sought, as a first step, to give effect to the agreement between the parties to convert the award to a 38 hour week, by an adjustment to the rates of pay. Proposed future variations to the rates of pay will be by a two step process and by separate application for each proposed adjustment.

[4] The parties have agreed that where the increase is less than 5% it will be implemented in one step and where the increase is in excess of 5% the increase will be implemented in two equal steps.

[5] The parties have also agreed that when considering the application to implement the third step in the process they would consider a review of the classification structure and its expression in the award.

[6] Public Notices were placed in the major newspapers to allow any party who may apply the rates and conditions of the award the opportunity to present submissions. No submissions were received by the announced closing date of 24 November, 2003.

[7] This consent variation amends Clause 8 - Wage Rates and Clause 14 - Hours and is to take effect from the first full pay period to commence on or after 1 December 2003.
