Industrial agreement - application approved - operative date ffpp 2 October 2003 to 31 October 2004 - forwarded to A/Registrar for registration REASONS FOR DECISION [1] On 26 September 2003 the Health Services Union of Australia, Tasmania No. 1 Branch and Healthscope Limited lodged with the Acting Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Healthscope Limited and Health and Community Services Union Enterprise Bargaining Agreement 2002. [2] When this matter came on for hearing on 2 October 2003, Mr T Kleyn appeared for the Union. Mr J Wigan appeared for the employer. [3] Mr Kleyn explained that this Agreement covered employees in the Hobart Private, Mersey Community and St Helens Private hospitals. [4] Negotiations had commenced some time ago with the then owners, Mayne Health. The subsequent purchase by Healthscope meant that the negotiations were inevitably delayed and explains why the Agreement provides for certain retrospective wage adjustments. [5] Mr Kleyn said that the Agreement was a comprehensive document, which included 6 weeks' paid maternity leave, enhanced long service leave and certain flexibility provisions. [6] T he Agreement had been endorsed by the HSUA membership. [7] Mr Wigan supported the submissions of Mr Kleyn. [8] I am satisfied that the Agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act. [9] Pursuant to s.55[4], the agreement is approved operative from the beginning of the first pay period to commence on or after 2 October 2003 and shall remain in force until 31 October 2004. [10] The file will now be referred to the Acting Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
