REASONS FOR DECISION

[1] On 29 September 2003, an application was lodged by the Transport Workers' Union of Australia (Victorian/Tasmanian Branch) (the union), pursuant to s.23 of the Industrial Relations Act 1984, to vary the Carriers Award.

[2] The application sought to delete and to replace Division B of Clause 8 - Wage Rates.

[3] A hearing was scheduled at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Friday 14 November 2003 at 10.30 am and was adjourned until 27 November 2003 at 9.30 am. On this date Mr M Cook appeared for the union and Mr M Watson appeared for the TCCI.

[4] Both parties gave oral submissions in support of the application. Having considered these submissions, I am satisfied that the application satisfies s.36 of the Act, therefore the award will be varied in the manner sought.

[5] The order reflecting this decision, with an operative date of 14 November 2003, is attached.
