Award variation - consent matter - application granted - award varied - operative date ffpp 14 November 2003

REASONS FOR DECISION

[1] On 29 September 2003 an application was lodged by the Transport Workers' Union of Australia (Victorian/Tasmanian Branch), pursuant to s.23 of the Industrial Relations Act 1984, to vary the Carriers Award. The application sought to vary Clause 43 - Travelling Allowance.

[2] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Friday 14 November 2003 at 10.00 am.

[3] At the hearing Mr H Smith and Mr M Cook appeared for the union and Ms J Thomas appeared for the Tasmanian Chamber of Commerce and Industry Limited.

[4] Oral submissions were presented by Mr Howard and Ms Thomas. Mr Howard amended the application on the record so that the work related allowance would reflect the CPI indicators.
