Award variation - expense related allowances - applications approved - operative date ffpp 30 October 2003 REASONS FOR DECISION [1] On 29 September 2003 applications were lodged by the Construction, Forestry, Mining and Energy Union, Tasmanian Branch, pursuant to Section 23 of the Industrial Relations Act 1984, to vary the Building and Construction Industry Award and the Building Trades Award with respect to expense related allowances. [2] When these matters came on for hearing on 30 October 2003, Mr T Benson appeared for the applicant. Mr P Mazengarb, appeared for the Tasmanian Chamber of Commerce and Industry Limited. [3] Mr Benson explained that these applications sought to vary expense related allowances to reflect movement in the CPI [Average of Eight Capital Cities] between the June Quarter 2002 and the June Quarter 2003. In accordance with previous practice different ABS indices are used to reflect actual changes in the various allowance categories. [4] In the case of the Building and Construction Industry Award, certain allowances relating to Fares and Travel and Living Away From Home, whilst formally part of the application, were not varied due to an absence of change in the relevant CPI indice. [5] Mr Mazengarb consented to the applications. [6] I am satisfied the applications are consistent with both the Wage Fixing Principles and the public interest requirements of the Act. [7] The applications are granted and the Awards will be varied operative from the beginning of the first pay period to commence on or after 30 October 2003.
