REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984, by Australian Municipal, Administrative, Clerical and Services Union (the Union), The Royal Automobile Club of Tasmania Limited and RACT Insurance Pty Ltd (hereafter called the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] On 9 October 2003, the Commission convened a hearing at the Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania, before myself, to commence on Wednesday 15 October 2003 at 10.30am.

[3] The agreement, to be known as the Australian Municipal Administrative, Clerical and Services Union/The Royal Automobile Club of Tasmania Limited and RACT Insurance Pty Ltd Staff Agreement 2003, is to be operative from the first full pay period to commence on or after the date of approval, and remain in force until 31 December 2005.

[4] When this matter came on for hearing, Mr I Paterson appearing for the union, and Mr M Watson, Tasmanian Chamber of Commerce and Industry Limited, for the employer, presented submissions in support of the application. They indicated that the agreement before the Commission follows on from a series of agreements.

[5] The parties took the Commission through the provisions that departed from those earlier agreements.

[6] Having considered the submissions of the parties, I approve the agreement. It is consistent with the public interest requirements of the Act. I also determine that it be operative from the first full pay period to commence on or after 15 October 2003 and remain in force until 31 December 2005.

[7] The file will now be referred to the Acting Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
