REASONS FOR DECISION

On 7 October 2003, an application was lodged by the Construction, Forestry, Mining and Energy Union ("the union"), pursuant to s.23 of the Industrial Relations Act 1984, to vary the Mobile Crane Hire Award. The application sought to vary Clause 2 - Fares, Travel and Accommodation of Part III - Wages and Related Matters, Clause 2 - Meal Breaks of Part IV - Hours of Work, Shiftwork and Overtime and Clause 2 of Part VII - Occupational Health and Safety, Tools and Amenities.

A hearing commenced on Tuesday 18 November 2003 at 9.30 am. At the hearing Mr T Benson appeared for the union and Mr P Mazengarb appeared for the Tasmanian Chamber of Commerce and Industry Limited.

Both parties gave oral submissions in support of the application. Having considered these submissions, I am satisfied that the application satisfies s.36 of the Act, therefore the award will be varied in the manner sought.

The order reflecting this decision, with an operative date of 17 November 2003, is attached.
