Industrial Agreement - agreement approved - operative 20 April 2003 until 30 September 2005 - forwarded to the Acting Registrar for registration REASONS FOR DECISION [1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the National Union of Workers (Central Branch) (the union) and The King Island Dairy Company Pty Ltd (the employer), was for the purpose of filing an industrial agreement with the Commission. [2] A hearing commenced at the Supreme Court, Cameron Street, Launceston, Tasmania on Tuesday 2 December 2003 at 9.30 am. [3] The agreement, to be known as the King Island National Foods Limited Enterprise Agreement 2003-2005, is to be operative on and from 20 April 2003 until 30 September 2005. [4] The agreement applies to all employees at the employer's operations at King Island who are engaged in the occupations, industries and callings specified in the award. [5] At the hearing it was agreed that Clause 19 - Carers Leave and Clause 33 - Access to Files be amended. Oral submissions were presented by Mr P Richardson for the union and by Ms Cheryl Disher for the employer. [6] Having considered those submissions, I am satisfied the agreement should be approved as it satisfies s.36 of the Act. [7] The file will now be referred to the Acting Registrar in accordance with the requirements of s.56(1) of the Act.
