Industrial agreement - application approved - operative date ffpp 12 November 2003 - forwarded to A/Registrar for registration REASONS FOR DECISION (1) On 28 October 2003 the Health Services Union of Australia, Tasmania No. 1 Branch and Healthscope (Tasmania) Ltd lodged with the Acting Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, The Healthscope Limited (Hobart Private Hospital) Combined Enrolled Nurse and Administrative Positions Industrial Agreement 2003. (2) When this matter came on for hearing on 12 November 2003, Mr T Kleyn appeared for the union. Mr J Wigan appeared for the employer. (3) Mr Kleyn explained that the purpose of the Agreement was to facilitate Administrative and Clerical employees who are qualified and registered as Enrolled Nurses to work across both functions as the need arises in the Department of Emergency medicine. An appropriate wage level for employees involved has been agreed and is reflected in Clause 6 Wage Rates. (4) Mr Wigan indicated that this arrangement would enhance flexibility and may avoid the need on occasions for the hospital to go on emergency by-pass. (5) I am satisfied the Agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act. (6) Pursuant to s. 55[4] of the Act the Agreement is approved operative from the beginning of the first pay period to commence on or after 12 November 2003. (7) The file will now be referred to the Acting Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
