COMMISSIONER P C SHELLEY

HOBART, 27 November 2003

Award variation - consent matter - application granted - award varied - operative date ffpp 1 December 2003

REASONS FOR DECISION

[1] On 29 October 2003 an application was lodged by the Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union, pursuant to s.23 of the Industrial Relations Act 1984, to vary the Metal and Engineering Industry Award.

[2] The application sought to amend Part III - WAGE RATES AND RELATED MATTERS, Clause 6 Phasing in of Wage Rates of Employees Without Relevant Work Experience by deleting C7 and 5 and replacing them with C5 and 3 respectively.

[3] A hearing commenced on Wednesday 12 November 2003 at 3.00 pm. At the hearing Mr P Baker appeared for the Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union. No appearance was made by the Tasmanian Chamber of Commerce and Industry Limited but the draft order was approved by Mr M Watson at a later date.

[4] Mr Baker gave an oral submission in support of the application. Having considered this submission, I am satisfied that the application satisfies s.36 of the Act, therefore the award will be varied in the manner sought.

[5] The order reflecting this decision, with an operative date of 1 December 2003, is attached.
