COMMISSIONER T J ABEY

HOBART, 28 November 2003

Industrial agreement - application approved - operative date 1 July 2003 to 30 June 2004 - forwarded to A/Registrar for registration

REASONS FOR DECISION

(1) On 13 November 2003, the National Union of Workers (Central Branch) and GlaxoSmithKline Australia lodged with the Acting Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the GlaxoSmithKline Australia (Latrobe Site) Industrial Agreement.

(2) When this matter came on for hearing on 26 November 2003, Ms K Wood appeared for the union. Mr A Cameron, of the Tasmanian Chamber of Commerce and Industry Limited, appeared for the employer.

(3) Ms Wood advised that this Agreement was based on the previous agreement approved by Imlach C on 7 March 2002.1

(4) The Agreement provides for a 5% wage increase, less 0.569% to cover the cost of the increased insurance premium for income protection.

(5) A number of other cosmetic and formatting changes have also been made.

(6) Mr Cameron supported the submissions of Ms Wood.

(7) I am satisfied the Agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

(8) Pursuant to s.55(4) of the Act, the Agreement is approved operative from 1 July 2003 and shall remain in force until 30 June 2004.

(9) The file will now be referred to the Acting Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
