LAUNCESTON PRESBYTERIAN HOME FOR THE AGED INC. (MARANATHA RETIREMENT HOME LEGANA TRANSFER) INDUSTRIAL AGREEMENT 2003

REASONS FOR DECISION

[1] On 27 November 2003 the Health Services Union of Australia, Tasmania No. 1 Branch and the Launceston Presbyterian Home for the Aged Inc. lodged with the Acting Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Launceston Presbyterian Home for the Aged Inc. (Maranatha Retirement Home Legana Transfer) Industrial Agreement 2003.

[2] When this matter came on for hearing on 10 December 2003, Mr M Vizard appeared for the union. Mr R Philps appeared for the employer.

[3] Mr Vizard explained that the purpose of this Agreement was to facilitate the transfer of accrued entitlements and other relevant employment matters arising from the transfer of employment from the Maranatha Retirement Home, Legana, to the Launceston Presbyterian Home for the Aged Inc. Matters covered in the Agreement include:

  • Salaries, classifications and conditions of employment
  • Annual leave
  • Sick leave
  • Long service leave
  • Other accrued entitlements
  • Contracted hours of employment
  • Probationary periods
  • Training agreements
  • Superannuation
  • Anniversary dates

[4] Mr Philps confirmed the Agreement and expressed satisfaction as to the constructive nature of the negotiations with the HSUA.

[5] I am satisfied the Agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[6] Pursuant to s.55[4] of the Act, the Agreement is approved operative from 24 November 2003 and shall remain in force for a period of 12 months.

[7] The file will now be referred to the Acting Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
