REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 (the Act) by the Shop Distributive and Allied Employees Association, Tasmanian Branch (the union) and Fairview Festival Supermarket (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] On 1 December 2003, the Commission convened a hearing at the Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania, before myself, to commence at 10.30 am on 10 December 2003.

[3] The agreement, to be known as the Fairview Festival Supermarket - Shop, Distributive and Allied Employees Association - Tasmanian Branch Agreement 2003, be operative from the first full pay period to commence on or after 1 October 2003 and remain in force until 1 October 2006.

[4] The agreement contains wage rates and conditions of employment.

  • $10 payable on and from 1 October 2003;
  • $10 payable on and from 1 October 2004; and
  • $10 payable on and from 1 October 2005.

[5] Mr P Griffin for the union and the employer presented a submission in support of their consent application. He said existing employees also endorsed the content of the agreement.

[6] Having considered the submission presented by Mr Griffin for the parties, I am satisfied the agreement should be approved as it is consistent with the public interest requirements of the Act, and I decide accordingly.

[7] The file will now be referred to the Acting Registrar in accordance with the requirements of s.56(1) of the Act.
