REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Shop, Distributive and Allied Employees Association, Tasmanian Branch and Statewide Independent Wholesalers Limited, was for the purpose of filing an industrial agreement with the Commission.

[2] On 8 December 2003, the Commission convened a hearing at the Supreme Court, Cameron Street, Launceston, Tasmania, before myself, to commence on Friday, 19 December 2003 at 9.30 am.

[3] The agreement, to be known as the Statewide Cash n Carry / Foodservice Division - Shop, Distributive & Allied Employees' Association Enterprise Agreement 2001 - 2004, is to be operative from the first full pay period on or after 1 August 2001 and it is to remain in force until 1 August 2004.

[4] The agreement applies to all employees employed within the following trade branches of the company and for whom classifications appear in the agreement:

    (a) Launceston Cash n Carry / Foodservice, 61 Oakden Road, Prospect;

    (b) Devonport Cash n Carry / Foodservice, 31-33 Don Road, Devonport;

    (c) Hobart Cash n Carry / Foodservice, 44 Gormanston Road, Moonah.

[5] Mr J Russell for the Shop, Distributive and Allied Employees Association, Tasmanian Branch and Mr D Sutherland for Statewide Independent Wholesalers Limited, presented submissions in support of the consent application.

[6] Having considered the submission of the parties, I am satisfied the agreement should be approved as it is consistent with the public interest requirements of the Act, and I decide accordingly.

[7] The file will now be referred to the Acting Registrar in accordance with the requirements of s.56(1) of the Act.
