TASMANIAN INDUSTRIAL COMMISSION

Industrial Relations Act 1984
s.23 application for award or variation of award

Shop, Distributive and Allied Employees' Association, Tasmanian Branch
(T11212 of 2003)

HAIRDRESSING, HEALTH AND BEAUTY INDUSTRY AWARD

DEPUTY PRESIDENT R J WATLING

HOBART, 24 December 2003

Award variation - application amended - wage rates - increased relativities for beauty consultant, salon coordinators and salon assistant - State Minimum Wage - consequential renumbering of Savings clause - consent matter - application granted - award varied - operative date ffpp 1 January 2004

REASONS FOR DECISIONS

[1] This application was made by the Shop, Distributive and Allied Employees Association, Tasmanian Branch (the Union) pursuant to s.23 of the Industrial Relations Act 1984.

[2] In its Reasons for Decision dated 2 October 2003 the Commission as currently constituted acknowledge:

"The parties present at the hearing also foreshadowed their intention to review the wage relativities for the classifications of Salon Co-0rdinator and Salon Assistant contained in Part III - Wages, Allowances and Related Matters - Clause 2(a), and the classifications of Beauty Consultant Level 1 and Salon Co-0rdinator contained in Part III - Wages, Allowances and Related Matters - Clause 2(b) of the award. This, they submitted, would be undertaken during their discussions surrounding the introduction of the Minimum Wage to this award and would result in an application being lodged with the Commission prior 31 December 2003."

[3] This amended application sought to vary the Hairdressing, Health And Beauty Industry Award to give effect to the previously expressed intention. Exhibit G1 clearly outlined the variations sought.

[4] Mr P Griffin for the Union, Mr A Steven for The Hairdressing Federation of Tasmania and Ms J Thomas for the Tasmanian Chamber of Commerce and Industry Limited, presented submissions in support of the consent application which they agreed should be operative from the first full pay period to commence on or after 1 January 2004.

[5] Given the submissions of the parties and the degree of consent, I approve the variation to the award in the manner sought by the parties, as the variations complete the minimum rate process for this award and the inclusion of the State Minimum Wage is consistent with a previous determination of the Commission.

[6] The Order giving effect to this decision is attached.
