Application by an organisation for registration as an organisation of employees - registration granted with effect from 19 June 2003 - Registration of disbanded organisation cancelled from same date

REASONS FOR DECISION

[1] On 8 May 2003, the Australian Industrial Registry certified alterations to the rules of the federally registered National Union of Workers that effectively disbanded the Tasmanian Branch. Transitional arrangements were included so that members of the Tasmanian Branch became members of the Central Branch of the union.

[2] As a consequence, the National Union of Workers lodged these applications to register the Central Branch and cancel the registration of the Tasmanian Branch.

[3] Having regard to the submissions of Mr T. Kennedy, at a hearing on 12 June 2003, I am satisfied that the application for registration by the National Union of Workers (Central Branch) complies with the requirements specified in the Industrial Relations Act 1984 and the application is granted from the date of this decision.

[4] The registration of the National Union of Workers, Tasmanian Branch, is also cancelled effective from the date of this decision.

[5] I shall now forward the application for registration to the President for referral to a Commissioner for the determination of award interest.

[6] A certificate of registration will be issued pursuant to Section 64(1) following the determination of award interest.
