Industrial Agreement - agreement approved - operative 20 January 2004 - for a period of 1 year - forwarded to the Acting Registrar for registration REASONS FOR DECISION [1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Minister Administering the State Service Act 2000, the Health Services Union of Australia, Tasmania No. 1 Branch and The Community and Public Sector Union (State Public Services Federation Tasmania) Inc., was for the purpose of filing an industrial agreement with the Commission. [2] On 5 January 2004, the Commission convened a hearing at Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania, before myself, to commence on 8 January 2004. However, at the request of the parties, this was subsequently changed to 13 January 2004 at 10.30 am. [3] The agreement, to be known as the Department of Health and Human Services Royal Hobart Hospital Core Laboratory Roster Agreement 2003, is to be operative from the date of registration [being 20 January 2004] and it is to remain in force for a period of one year. [4] The agreement applies to employees employed as full-time and part-time shift workers, including quarantined shift workers, covered by the Community and Health Services (Public Sector) Award who work in the Core Laboratory of the Royal Hobart Hospital. [5] Mr R Clegg for the Minister Administering the State Service Act 2000, Ms R McQueeney with Mr R Miller for The Community and Public Sector Union (State Public Services Federation Tasmania) Inc. and Ms L McDougal for the Health Services Union of Australia, Tasmania No. 1 Branch, presented submissions in support of their consent application. [6] Having considered the submission of the parties, I am satisfied the agreement should be approved as it is consistent with the public interest requirements of the Act, and I decide accordingly. [7] The file will now be referred to the Acting Registrar in accordance with the requirements of s.56(1) of the Act.
