REASONS FOR DECISION

[1] On 21 July, an application was lodged by The Australian Workers' Union, Tasmania Branch (the union), pursuant to s.23 of the Industrial Relations Act 1984, to vary the Butter and Cheesemakers Award.

[2] The application sought to vary the award from the first full pay period on or after 1 December 2003 to give effect to the second adjustment to wages in accordance with the minimum rates adjustment principle.

[3] This matter was heard at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Friday 12 December 2003 at 2.30 pm.

[4] At the hearing Mr R Flanagan appeared on behalf of the union. Mr P Mazengarb appeared for the Tasmanian Chamber of Commerce and Industry Limited.

[5] The variations are consistent with the Wage Fixing Principles and the public interest requirements of the Act.

[6] The Order giving effect to this Decision is attached.
