REASONS FOR DECISION

[1] On 8 August 2003, an application was lodged by the Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union, pursuant to s.23 of the Industrial Relations Act 1984, to vary the Draughting and Technical Officers (Private Industry) Award.

[2] A hearing was convened at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on 25 September 2003 and continued on 16 and 23 June 2004.

[3] At the hearings Mr P Baker appeared for the Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union. On 25 September 2003 Ms J Thomas appeared for the Tasmanian Chamber of Commerce and Industry Limited (TCCI). At the hearings in June 2004 Mr R Rollins appeared for the TCCI.

[4] Mr Baker, Mr Rollins and Ms Thomas presented oral submissions in support of the application. The changes are detailed in Appendix 1 - Summary of Changes of the award attached to this decision.

[5] Having considered those submissions, I am satisfied the variations do not offend s.36 of the Act or the Wage Fixing Principles and I approve the variations.

[6] The Order giving effect to this Decision is attached.
