REASONS FOR DECISION

[1] On 19 December 2003, an application was lodged by the Australian Municipal, Administrative, Clerical and Services Union, pursuant to s.23 of the Industrial Relations Act 1984 ("The Act"), to vary the Insurance Award.

[2] The application sought to delete all clauses in the award and to insert new clauses to give effect to Principle 13 - Award Review Process of the Commission's Wage Fixing Principles.

[3] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Tuesday 6 January 2004 at 10.30 am. At the hearing Mr I Paterson appeared for the Australian Municipal, Administrative, Clerical and Services Union. Ms J Thomas appeared for the Tasmanian Chamber of Commerce and Industry Limited with Mr N Gozzi.

[4] Both parties gave oral submissions in support of the application.

[5] The award will be varied in the manner sought. The variations are consistent with the Wage Fixing Principles and the public interest requirements of the Act.

[6] The Order giving effect to this Decision is attached.
